Conveyancing FAQs
What is Conveyancing?
Conveyancing is the process of transferring the legal ownership of real estate from one person to another. It sounds simple, but the fact that conveyancing is a legal procedure introduces a number of complexities.
How long does a Conveyance usually take?
A Conveyance typically takes between 4-6 weeks. Your Conveyancer will work through a checklist, as well as any special agreements between the buyer and seller before the transaction is finalised.
What is the cost of Conveyancing?
The costs of conveyancing will vary. Conveyancing costing is customised to each property within the transaction and also depends on whether you are buying or selling.
Who can do Conveyancing work?
A consumer has 3 options for completion of a conveyancing matter:
- Engage a lawyer to attend to legal work as well as conveyancing work;
- Have a licensed conveyancer represent you; or
- Use a do it yourself conveyancing kit.
What is the difference between a lawyer and a Conveyancer?
A lawyer is a person who is trained to advise clients on their legal rights and obligations in a variety of circumstances, including the buying and selling of real estate and the conveyancing process.
A conveyancer is a person who is licensed to assist buyers and sellers of real estate through the conveyancing process, but cannot advise on areas of law that are beyond ‘conveyancing work’ as defined in the Conveyancers Act 2006.
What is 'gazumping' and does it still occur?
Gazumping occurs when a vendor refuses to formalise a firm agreement to sell to the purchaser at the last minute in order to accept a higher offer. In Australia it is assumed that a purchaser understands that a sale has not taken place until the contract has been fully executed (signed by both parties), and that a purchaser who claims to have been ‘gazumped’ has failed to understand the law as it applies to real estate sales.
What is a cooling off period?
Cooling off is a term used to describe the right of a purchaser of real estate to cancel the contract and walk away from the purchase on a ‘no questions asked’ basis within a specified period of time.
Should I have the Contract & Section 32 checked before I buy?
Yes – Conveyancing begins AFTER you have purchased real estate.
Too many consumers fail to obtain legal advice from a qualified lawyer before they buy, and this can lead to enormous problems after the sale has taken place.
What do I need to know about real estate contracts?
The most important thing a consumer, whether vendor or purchaser, should know about real estate contacts is that real estate agents should NEVER be permitted to touch them. Before a purchaser signs any written documents associated with the purchase of real estate, and before a vendor signs any written document to accept an offer to purchase a property, they should obtain legal advice from a qualified lawyer.
Why hire a solicitor for buying property?
When you purchase a new home, a carefully reviewed and negotiated contract could help protect you from potential issues during and after the purchase process.
You can undertake this yourself, but using an experienced legal professional could give you peace of mind and help you avoid potential issues
