What is an Enduring Power of Attorney?

An Enduring Power of Attorney is a document which allows you to nominate another person to have the power to make decisions on your behalf.  The decision making power can be in relation to your financial matters and/or health matters.  You can impose conditions and limitations on these powers.

Why would I need an Enduring Power of Attorney?

The need for an Enduring Power of Attorney commonly arises when a person is too ill to make or communicate their decisions, or to organise their own health or financial matters.

You may also elect for an Enduring Power of Attorney to operate when you are travelling overseas for an extended period of time and yo require someone to manage your financial affairs in your absence.

In order to make an Enduring Power of Attorney, you must have the capacity to make decisions at that time.  If your decision making capacity is diminished, then you will not be able to make a valid Enduring Power of Attorney.  For this reason, we recommend you make an Enduring Power of Attorney as soon as possible to ensure your financial and health matters will be overseen by a person of your choice in the event you are not able to take care of such matters for yourself.
